Karmelo Anthony's legal team has submitted new motions seeking both a retrial and the removal of Judge John Roach from overseeing his case. Anthony, who was convicted of murdering 17-year-old Austin Metcalf during a track meet in Frisco, Texas, is currently serving a 35-year prison sentence.
As part of the appeals process, Anthony's family has engaged a new legal team led by Attorney Russell Wilson, who will represent him pro bono due to Anthony's financial constraints regarding attorney fees.
The defense filed a verified motion to recuse Judge Roach, citing his comments to the media after the trial, where he expressed personal opinions on the jury's verdict and the fairness of the trial. In a statement to reporters, Roach affirmed that the jury's decision was correct and defended his rulings, including the dismissal of three Black potential jurors, claiming he adhered strictly to the law. The defense argues that these comments suggest potential bias in Roach's decision-making regarding the appeal.
In addition to the recusal motion, the defense has also requested a new trial, claiming that Anthony's constitutional rights were violated during the original trial. The 63-page motion outlines several issues, including the claim that the trial was effectively closed to the public, which they argue infringed upon Anthony's Sixth Amendment right to a public trial. They also contend that prosecutors breached an evidentiary agreement, which left Anthony vulnerable to damaging testimony.
Further, the defense asserts that jury instructions were misleading and complicated the jury's ability to consider self-defense. They argue that the cumulative impact of these alleged errors necessitates a new trial.
